Abstract

This study explored various categories of content regulated in cyberspace, the challenges that come with regulation and possible solutions to overcome the challenges. Reviewing of documents including documents available in e-sources and conducting a comparative analysis on the legal framework on regulation of online content in Kenya, USA, China and European Union was the research methodology approach used. The research found that cyberspace presents high rates of misinformation, fake news and hate speech and harmful content affecting children. The study also found that some of the challenges experience include, anonymity, jurisdictional complexities and balancing of human rights. The study established that developed countries have been able to address the challenges of regulating online content by enhancing their legal framework and building on robust technological measures to control harmful and illegal content. The study recommends for a collaborative and cooperative approach towards strengthening Kenya’s legal framework on online content regulation.
