Abstract

As AI machines advance, they blur the lines between human and machine creativity, thus raising difficult questions about authorship, ownership, and liability.The dynamic landscape requires re-evaluating the current intellectual property rights framework to ensure it remains appropriate and effective in protecting innovation and spurring technological advancement. Existing laws are designed with human design in mind and attempt to accommodate the unique characteristics of AI-driven innovation. This article explores the difference between AI and Intellectual Property (IP) law by examining the challenges posed by machine learning algorithms that create art, write code, and even create new products. It delves into the implications for patent law, copyright protection, and commercial rights in an era when AI can surpass human creativity.This combination of enhancing human creativity with AI tools opens up new areas of intellectual property law. How do we own and protect the rights of individuals and partners in this partnership? This article outlines the foundation for addressing this phenomenon, proposing legal reforms and policy recommendations to balance incentives for innovation with fair recognition of the role of intelligence in the production process.
