Abstract

Pacta sunt servanda which means “agreements are binding”, is a fundamental principle of contract law which can be applied in both international and municipal spheres and it has far reached implications for contract interpretation and enforcement. International and national law are two distinct but interconnected legal systems that operate within a framework in terms of the International legal system. While international law governs state relations, national law governs the behaviour of individuals and businesses within the jurisdiction of a specific state and as such the purpose of this study is to examine the evolution of the doctrine of pacta sunt servanda in relation to international and national spheres and the ways the two systems interact
