An Introspection into People-Centered Justice Approach in Kenya: A Case Study of Social Transformation Through Access To Justice

Abstract

In a democratic society governed by the rule of law, the concept of access to justice remains one of the fundamental tenets of constitutionalism. Justice is an indicator of true peace in a society. The people-centered justice system is a rule of law concept that relies on the needs and strengths of justice users to ensure effective access to legal and justice services. This paper examines the people-centered justice approach system in Kenya towards enhancing access to justice. The paper explores the significance of placing the people and their needs at the center of a justice system in ensuring effective access to justice. The study sought to understand the people-centered justice approach adopted by the judiciary under the STAJ strategic plan and how it enhances access to justice. In addition, the study sought to establish how the policy bridges the access to justice gap, especially among the vulnerable and marginalized groups. Moreover, the study found cases of impediments to some of the proposed judicial reforms meant to promote the spirit of the Constitution towards access to justice. The research content relied on the literature review of journal articles and case laws to tackle the research objectives. Ultimately, the research makes recommendations for a successful people-centered justice system.
