Assessing the Contribution of Community Justice Centers in Enhancing Police Accountability in Kenya – Selected Community Justice Centers in Nairobi County, Kenya

Abstract

Community justice centers have emerged as critical grassroots mechanisms for enhancing police accountability in Kenya's informal settlements, where residents face systematic challenges in accessing formal justice systems. This study assessed the contribution of community justice centers in promoting police accountability in Kenya, with particular focus on the Kayole and Mathare Justice Centers in Nairobi. Against the backdrop of persistent police accountability challenges rooted in historical brutality, corruption, and chronic underfunding that has resulted in inadequate officer training and compromised institutional capacity, community justice centers provide accessible platforms for residents to report misconduct and seek redress. The study was theoretically grounded in procedural justice theory and broken windows theory of police accountability, employing a descriptive research design to investigate these dynamics. The target population comprised 86 community members who actively engage weekly with the two selected justice centers, chosen due to the high prevalence of police misconduct in these informal settlements and the correspondingly high volume of reported cases as per Kituo Cha Sheria 2020 annual report. Using multi-stage sampling techniques combining purposive and stratified simple random sampling, the study selected 70 households from communities served by the two justice centers. Data analysis employed descriptive statistics for quantitative data and thematic analysis for qualitative information gathered through key informant interviews and focus group discussions with oversight bodies, civil society organizations, and community representatives. The findings revealed that community justice centers play a pivotal role in documenting and addressing police misconduct by providing accessible platforms for reporting and promoting accountability mechanisms. A majority of respondents acknowledged significant improvements in police accountability through systematic case management, sustained advocacy efforts, and facilitated community dialogues. The centers successfully enhanced collaboration with oversight bodies and civil society organizations, contributing to improved peace and trust between communities and the criminal justice system. However, the study identified substantial constraints, including limited financial resources, bureaucratic obstacles, and resistance from some law enforcement officers, which collectively undermined the centers' potential effectiveness. The study concludes that community justice centers make significant contributions to enhancing police accountability, particularly in informal settlements across Nairobi. By providing accessible platforms for reporting and resolution, these centers have strengthened citizen trust, improved police-community relations, and effectively complemented formal oversight mechanisms. Nevertheless, systemic barriers and resource constraints continue to limit their overall impact on police accountability. The research recommends that policy actors and stakeholders prioritize strengthening the capacity of community justice centers through increased funding, comprehensive staff training in case management and mediation techniques, and the development of stronger partnerships with the National Police Service and oversight agencies. Furthermore, the study advocates for the formal institutionalization of community justice centers within Kenya's justice system as complementary accountability mechanisms and calls for expanded community outreach and awareness programs to ensure broader resident access to these vital services.
